One Space TERMS OF BUSINESS AND CODE
No one likes surprises. This section sets it all out. If you decide to start your journey with One Space, this section constitutes the terms of your agreement with One Space. It should also address most administrative questions that you might have. But if you have any more, please reach out.
Training eligibility
This agreement is with ‘you’ (our client) and One Space ‘us’/ ‘we’. To be eligible to use the facilities known as One Space, our studio or coaching and training services you must be at least 14 years of age. The following applies if you are under 18 years of age:
Under 18 years of age: A parent or guardian must agree to these terms and conditions, any questionnaires, attendance at classes and training programs in writing before you commence your training with us.
Under 16 years of age:
(a) A parent or guardian must agree to these terms and conditions, any questionnaires, attendance at classes and training programs in writing before you commence your training with us; and
(b) you may not undertake any unsupervised resistance training or take part in group classes that use weights (including circuits and boxing type exercises).
Training session options
Training sessions (private coaching, group sessions, consults, workshops) can be casual or contracted (membership) for 1, 3 or 6 months. The minimum membership period is 1 month.
Non-contracted training sessions are available to clients who prefer a casual arrangement and who do not wish or cannot, make a commitment. The full rate will be payable at the time of booking and apply to these sessions, with no discounts offered.
Training sessions, either one-on-one or in small groups, can also be for contracted periods with commensurate tenure and frequency-based discounts offered.
Packs are also available for purchase for group classes only. Packs are NON-REFUNDABLE nor TRANSFERABLE but can be placed on hold for substantiated medical reasons (see Freezing Membership or Packs below).
Our rates are available following an initial consultation with us and may be subject to change on 14 days’ notice.
Your contract with One Space
You have an agreement and a legally binding contract with us when you accept our terms of business by signing this agreement. If these terms and conditions or your agreement differ from anything you are told at the studio or over the phone, these terms and your agreement will apply, unless written confirmation is received from a One Space employee.
Limitation of Liability
To the extent permitted by law and without limiting any non-excludable consumer rights you may have, we (and our affiliates) will not be liable for any direct, indirect, incidental, special, consequential or punitive loss or damage, loss of profits, revenue, expectation, business, savings, data or unavailability of systems or any other loss whatsoever, whether arising under contract, statute, tort (including negligence) or otherwise, in connection with our website, facilities and services, or any use of or access to, or any inability to use or access to our website, facilities and services.
You will hold us and our affiliates harmless against any claims, proceedings losses, liabilities, costs or other expenses (including legal costs) incurred by you in connection with, whether directly or indirectly, your breach of these terms and conditions, your use or access of our website, facilities and services or any violation by you of any applicable law or these terms and conditions.
Payment for our services
You pay membership fees for ongoing arrangements (1, 3 or 6 months) weekly in advance, by direct debit from a bank account or credit card. You can pay your fees as far in advance as you like, up to the legal time limits. However, you still need to give us your account details for when your advance payments end. Your fees will continue to be debited from your account until you or we cancel the arrangement by advising your bank or credit provider. If you end this agreement or stop the automatic debit arrangement in a way not described in these terms and conditions, you may be liable for damages for breach of contract
You can also pay upfront for your membership.
Fees
There are no start-up fees with One Space.
There may be cancellation fees. See ‘Cancellation Policy’ for further information.
All fees for products and services include goods and services tax (GST). Your fees will change in line with any government GST rate changes.
One Space Direct Debit provider is Quickpay Pty Ltd. Direct debit fees apply. Please see ‘Direct Debit’ for more information. We are not responsible for fees you incur with either your financial institution nor Quickpay.
If you freeze your membership, a weekly fee of $5 will apply for the period.
From time to time we may change our pricing. In this situation we will provide you with 14 days’ notice. If you do not write to us to decline the change, the increase will automatically be applied to your direct debit. If you decline the change, you can cancel your membership per the cancellation section of these terms.
Membership Renewal
Your membership will automatically renew under the same terms and conditions and at the same rates, at the end of the period, unless advised by us with 14 days’ notice. Should you not wish to renew, please follow the Cancellation policy below.
If you change your mind
If you are a new client, you can cancel your membership within 14 days of sign-up (cooling off). We will then cancel your membership and refund the unused pro-rata component. Any direct debit fees incurred during this period will be deducted from your refund.
If you are late to a session
If you are late to a session, your session will conclude at the scheduled time. Any variation to this will be at your coach’s discretion
If you need to cancel or reschedule your session
We respect that your time is valuable and hope you understand that ours is too. When you book a session/class or workshop, your spot it is held especially for you and therefore, cannot be offered to another client. As such we have a 24-hour cancellation policy. Any cancellation that occurs 24 hours or more before the scheduled time can be rebooked at no additional cost within a two-week period, unless you cannot do this in which case you will be charged your missed session cost.
If you cancel within the 24hr period you will be charged the full session cost.
If you cancel your membership outside of the cooling off period, you will be charged the value of one month’s membership. A $25 admin fee will also apply.
Your obligations
You are responsible for following our Code. Please see ‘One Space Code’
You are responsible for any guests, including minors or children that accompany you. Whilst there are non-exercise designated areas within the studio, coaches and staff cannot supervise your guests including children.
Our staff and contractors are not medically trained. They are not qualified to assess if you are in good physical condition and can exercise without risking your health, safety or comfort. Therefore, you are responsible for providing us with all relevant fitness and health information before or during your use of the studio or participation in any exercise. You must ensure you are in good health and physical condition and know of no medical reason why you cannot or should not exercise. If you are unsure, you should seek medical guidance before starting an exercise program with us.
If you are returning to us after a period of prolonged poor health or surgery, you must provide us with written evidence (from a medical practitioner) that confirms your ability to resume training and/or any associated limitations.
You may not visit the studio if you have an infection, contagious illness or physical ailment, such as an open cut or sore, or if there is any other risk, however small, to other clients and guests.
If you believe our activities might risk your health, you must tell us this in writing with full details. You must also tell us if your medical condition changes after you join.
Refusal of entry
We have the absolute discretion to refuse entry into the studio or ask you to leave. The following guidelines apply: You will be refused entry or asked to leave the studio if:
You are considered unwell during training, or if when entering the studio, you have a temperature above 37.5 degrees Celsius.
You have not made a booking
If you wilfully or through negligence, damage the studio, it’s equipment or another client’s property or you are using equipment in a manner that it was not intended, thereby putting your safety and the safety of others at risk
If you behave in a way that puts your safety and/or the safety of our members at risk and/or you harass or threaten other members
You are using performance enhancing drugs
If your arrangement has been cancelled by us
If there is any other risk, however small to other clients and guests
Intoxicated or appear to be under the influence of alcohol or drugs
Instructing other members when we have not authorised you to do so
You do not follow the One Space Studio Code
Membership Cancellation
The minimum period of membership is one month from the expiration of the cooling off period. If you cancel your membership outside of this period, either one month’s membership or payment in lieu of notice will be due.
Either you or we, may cancel your membership with us. When you cancel, you must provide a minimum of one months’ notice unless you are cancelling for medical reasons (with supporting evidence from your medical practitioner). We count this period from the date of your notification, this means your final debit may be a pro rata amount. To ensure your direct debit does not continue past your arrangement term, you must give us one months' notice within this term.
You cannot freeze your membership payments during the notice period.
You must pay us any fees you owe, or we may take action to recover them.
We may cancel your arrangement without warning if you:
damage the studio including all equipment, fixtures or other client’s property through a wilful act or negligence
if you behave in a way that is risky or seriously inappropriate, such as:
threatening or harassing others
using illegal or performance-enhancing drugs
instructing other members when we have not authorised you to do so
Using equipment in a manner that it was not intended, thereby putting your safety and the safety of others at risk.
Your payments are repeatedly declined and/or you owe us money
You do not follow the One Space Studio Code (see below)
If your membership is cancelled by us for any of these reasons, you will be liable for the balance of your entire membership.
To cancel your membership you must do so in writing via email hello@onespacewellness.com and state your full name and date of birth. Verbal notice will not be accepted.
You cannot freeze your membership payments during the notice period.
Freezing your membership
Pre-paid packs can be frozen for medical reasons (with written evidence from your medical practitioner) for a maximum period of 2 months.
You can freeze your membership from 1 or more fortnights, up to a maximum of 4 fortnights each calendar year. Your membership will be extended by the freeze period. The time freeze fee for all memberships is $5 per week, which you can pay in advance or by direct debit.
If you do not apply your time freeze on the set direct debit date, a credit will be applied towards your next fortnightly direct debit for those days from which the time freeze applies until the next direct debit date.
Using an ‘extended time freeze’
You can freeze your membership for up to 13 fortnights in any 12 months for travel, medical or bankruptcy reasons. However, we must be satisfied by your supporting documents, such as a certificate from a medical practitioner stating you are unable to exercise.
If you have a medical reason or become bankrupt, we will not charge you for this extended time freeze to allow you time to recover.
Understanding the conditions
Before freezing your membership, you must make sure your fees are up to date and you don’t owe us any money. Note that we cannot backdate any time freeze requests. You must request a freeze when you need it.
Refunds and expiration periods
Pre-paid packs are non-refundable and expire as follows: 10 Pack - 3 months and 20 pack – 5 months from the date of purchase. The exception to this will be for medical reasons (with supporting evidence from your medical practitioner) and in this situation the pack may be put on hold for a maximum period of 2 months.
Receiving a refund for a prepaid arrangement - If you pay for a training arrangement in full in advance, we will refund the fee within 6 months of purchase if:
the program is cancelled
you can show us medical evidence that the program will cause you physical harm or injury
the law requires us to refund the fee.
We will not refund you if the prepaid program has already expired.
Transfers
Memberships & packs are non-transferable.
Direct Debit
We are a cashless facility; therefore, we will debit your membership fees, weekly on Monday.
Quickpay Pty Ltd is our direct debit provider and charge the following fees which are payable by you:
One-off set up fee $2.20
Transaction fee $0.77c (per transaction)
Merchant surcharge 1.5% (Visa & Mastercard)
Merchant surcharge 4% (AMEX & Diners)
Payment rejection fee $8.80 (per rejection)
Please note that:
debit dates are pre-set for all members
if one falls on a public holiday, we will debit your account on the next business day

Meeting your responsibilities
You must make sure:
• your account can accept direct debits (your financial institution can confirm this)
• there is enough money in your account on the payment day and the next 5 days
• you tell us if you are transferring or closing your account, at least 48 hours before your next direct debit
• you tell us about any changes to your credit card, such as its expiry date or number, at least 48 hours before your next direct debit.
Please advise us in writing, and your financial institution if you want to change or stop your direct debits.
Querying a payment
If you query a payment, we will do our best to respond within 7 days. If you are not happy with our response, you may contact your financial institution. It will handle your query in line with its own policy.
What happens if your payment is late or fails?
If you do not have enough money in your account when fees are due, your financial institution may charge you a fee. Quickpay also charges a rejection fee of $8.80 which will be payable by you.
If you do not fully pay your fees on the due date, we will suspend your studio access until your payments are up to date and you have given us your account details. We will also charge you a late payment fee of $10 for a failed payment. This will be debited from your account, and you authorise us to do this.
Paying your outstanding debts
We will continue to debit your nominated account without notice, until we have received the total amount you owe us. We will make a reasonable effort to let you know beforehand by:
• phoning you or speaking to you
• writing to the address you last gave us.
For a membership/s in your name, you must make sure that the payment method you choose continues for the length of your agreement. This includes third-party accounts. If the details you give us fail, you are liable for all resulting fees. You should update your details and are obligated to complete your minimum term.
If you default in payment of your membership fees, we may send your outstanding debt to a third-party debt collection agency to collect your outstanding fees. If this debt is sent to a third-party further fees and charges may be payable.
Staying up to date with our terms
We may sometimes add to, change or remove our terms and conditions and we will do so without notice to you (unless it is a pricing change in which case, we will provide you with 14 days’ notice). This includes changing the studio’s opening and closing hours, its services and facilities. Sometimes, we may also need to close the studio for refurbishment to improve the facilities. We do not reduce your membership fees because the studio is closed for renovations or for a pre-advised period or public holiday. If we need to close for an extended period of time then we will provide you with 14 days’ notice.

Contact with One Space
By signing our agreement, you agree to receive information about us and our services. If you receive communications from One Space which you do not wish to receive, you may remove your name from the database by contacting One Space at hello@onespacewellness.com
How to give us feedback
Your feedback is important in helping us to provide a great service. If you have any comments, questions or concerns about One Space please email us at hello@onespacewellness.com and we will respond as soon as possible.
The One Space Studio Code
Please follow our studio code and any signs or guidelines. If you do not follow these, you may be asked to leave our studio, or your membership or pack may be frozen or cancelled. The following rules apply to our facility:
You are responsible for using our facilities and equipment correctly, including adjusting levels or settings. If you are not sure how to operate any equipment, please ask our staff before you use it.
Note that you will be responsible for any damage that you or your guests cause through a wilful act or negligence.
You must:
Make a booking to attend our facility via the ‘One Space’ App or via our website www.onespacewellness.com
Immediately on entry you must sanitise your hands at our sanitising station
Register your temperature and check-in before using the studio
Use a clean towel when you use equipment, including exercise mats
Wear deodorant
Wipe down equipment with our antibacterial solution after use and put your equipment away
Not move equipment from the designated area without speaking to one of the staff first
Exceed your booking time limit
Keep phone calls to an absolute minimum. Note also that you must not use a camera in our studio without written permission.
Respecting our Clients and Local Residents
As our building and nearby buildings include private residences, we ask that you arrive and leave our studio in a quiet and respectful manner.
Also, you must not:
Drop weights, they must be carefully lowered to the ground
Behave in a way that is risky or seriously inappropriate, such as:
Threatening, harassing others, swearing/or yelling
Using illegal or performance-enhancing drugs
Instructing other members when we have not authorised you to do so
Using equipment in a manner that it was not intended, thereby putting your safety and the safety of others at risk.
Keeping your belongings safe
We provide an area you can store your belongings while exercising but these are not security lockers. Please do not bring valuables into the studio.
Unfortunately, thefts do happen. We cannot accept responsibility for any loss or damage to your belongings while you are at the studio. If you leave belongings in the studio overnight, we may remove them.
Wearing suitable clothes
All clients and guests must wear suitable clothes and enclosed sports shoes. We do not allow clothes with offensive images or inappropriate advertising. Please also wear deodorant.
Parking
Parking is not provided. We are not liable for any parking fees you incur whilst using our studio. Nor are we responsible for any theft or damage to your vehicle.
Bringing a Guest
Guests must also abide to all aspects of the code and their attendance needs to be pre-booked to ensure our compliance with government requirements.
Your guest must:
Be at least 16 years old or if younger, must be directly supervised by you
Be accompanied by you and leave when you do
Check-in via our guest register
We do not have a child-minding facility. For security reasons, children can only wait in designated areas and are not permitted to wander around the studio. The accompanying adult must take full responsibility for their safety.
Meeting our conditions
Your responsibilities, including payment of fees, do not depend on how often you use a studio.
You must tell us about anything that affects your membership, and any changes to your contact and bank details.
Promising to take care of yourself and our community
You promise to:
Not attend the studio and therefore, either cancel or reschedule your session if you are unwell
Observe social distancing protocols
Make sure that you know how to exercise safely, by asking if necessary
Sanitise your hands when entering and leaving our studio
Wash your hands thoroughly when you use the toilet
Use your best endeavours to exercise safely
Not take valuables into the studio, even if you plan to put them in a personals room
Show consideration for local residents by entering and leaving our studio quietly
Privacy Policy
During your time as our client, we will have access to personal information about you, such as about your health and financial situation. We will only use, disclose or deal with your information in line with our privacy policy.
This Privacy Policy applies to the services offered by One Space (21 642 285 710)
1.Statement of Commitment
One Space is committed to protecting your privacy and any personal information we collect. One Space complies with the Privacy Act 1988 (Cth) and the National Privacy Principles. This policy explains how we may collect, use, disclose and otherwise handle personal and sensitive information.
One Space is committed to safeguarding personal privacy. It recognises that individuals have a right to control how their personal information is collected and used. Providing personal information is an act of trust and it is taken seriously. Unless given consent to do otherwise, One Space will only collect and use personal information as set out below.
For the purposes of this Privacy Policy personal information may mean some or all of the following:
A member’s name, contact details, date of birth, emergency contact details, bank account and/or credit card details, student identification details, employment details, payment history and sensitive information c us.
2. Collecting personal information
One Space will not collect or monitor any personal information about an individual without their consent. The only personal information collected is what is provided voluntarily by a member or prospective member.
We collect personal information primarily to enable us to provide members with our services or functions related our agreement with you and our terms and conditions.
One Space may also use the information for marketing to you or for any other purpose permitted under the Privacy Act 1988 (Cth).
You don’t need to identify yourself when you deal with us (e.g. to find out more about membership packages) however in certain situations we will only deal with individuals who have identified themselves to us.
When a membership, service or product is purchased personal information will be requested in order to provide the requested service or product, provide updated information, and advise of other One Space services or products, which may be of interest. You are not obligated to provide personal information however failure to do so may result in One Space being unable to provide services or products to you.
Personal information is collected directly from members or potential future members when they personally complete and submit an application form to become a client/member of One Space. This can be done in person at the Studio, on line via our website or via the One Space App available at the Apple App Store or on Google Play.
3. Collecting Sensitive Information
For the purposes of this Privacy Policy sensitive information means the information a member has disclosed to us about their physical and mental health and wellbeing.
Sensitive information will only ever be used for providing services to members. Such information will not be used or disclosed for any other purposes without consent, except in exceptional cases when disclosure may be required by law or is necessary to protect the rights or property of One Space, any One Space group company, or any member of the public, or to lessen a serious threat to a person’s health or safety. For the purposes of this Privacy Policy sensitive information is a subset of personal information.
4. Use of tracking technologies
One Space uses tracking technologies such as cookies or web beacons to make use of the website and services as convenient as possible. Cookies are pieces of information that a web site transfers to a computer’s hard disk for record keeping purposes. Web Beacon is a technical method that sends information related to the access to websites, when you browse websites, open or preview an HTML-formatted email. Most web browsers are set to accept tracking technologies such as cookies or web beacons. These tracking technologies do not themselves personally identify users, although they do identify a user’s browser. These tracking technologies allow One Space to monitor the One Space web site, and to record how many people are using the different parts of the site.
It is possible to set the browser to refuse tracking technologies such as cookies or web beacons, however, this may limit the services provided by One Space’s web site.
5. Using and disclosing your personal information
Personal Information will be used for the following primary purpose:
• To fulfil obligations under a member’s membership agreement and/or any other contract between him/her and One Space;
• To render services under a member’s membership agreement;
• To provide information about products, service and/or special offers to members;
• To obtain opinions or comments about products and/or services from members;
• To record statistical data for marketing analysis from members.
One Space may employ other companies or service providers (agencies) to assist us in providing our services or any functions related to our services, including (but not limited to) marketing, market research, mail-house services, debt recovery functions, hosting and product development services, analysis of member lists and/ or consulting services. For the avoidance of doubt, One Space may disclose your personal information to the agencies and our partner debt collection agencies and other parties that assist with debt collection. One Space may disclose, and these third parties may have access to the personal information that is needed to perform their specific function. They cannot use that information for other purposes.
One Space recognises the trust with which individuals provide personal information, and such information will not be used or disclosed for any other purposes without consent, except in exceptional cases when disclosure may be required by law or is necessary to protect the rights or property of One Space, any One Space group company, or any member of the public, or to lessen a serious threat to a person’s health or safety.
Allowing us to use your image
We sometimes film or photograph the studio so it is possible you will appear in the background or part of a photograph with us. By signing your agreement, you allow us to use your image in promotional and other business-related material. If you do not wish for your image or name to appear in any of our promotional and other business-related materials then please notify us at the time you enter into our agreement or afterwards at any stage in writing at hello@onespacewellness.com
Paying outside providers, including personal fitness coaches and instructors.
We may have contractors, tenants and franchisees provide some services in our studios, such as physiotherapy and massage. You will need to pay service fees directly to them and we are not responsible for those fees or for any associated costs or refunds
6. Contact by One Space
By signing our agreement, you agree to receive information about us and our services.
If you receive communications from One Space which you do not wish to receive, you may remove your name from the database by contacting One Space at hello@onespacewellness.com
7. Individual’s right of access
Individuals have the right to review, amend or delete personal and/or sensitive Information that may be recorded on the One Space database. Information may be reviewed, amended or deleted by emailing info@onespacewellness.com
A request may be made to delete personal and/or sensitive information, and all reasonable steps to delete the information will be made, except where it is required for legal reasons. Deletion of information may result in One Space being unable to sell products directly and/or provide certain services including after sales services.
8. Storage and security of personal and/or sensitive information
One Space takes all reasonable steps to keep secure personal information recorded and to keep this information accurate and up to date. The personal information is stored on secure servers if in digital format, or in locked areas if in hardcopy format: these repositories are protected in controlled facilities. In some cases, these facilities may be in locations outside Australia. One Space employees and data processors are obliged to respect the confidentiality of any personal and/or sensitive information held by One Space. One Space only permits authorised personnel to access your information and information will only be disclosed to third parties where they have the appropriate authority. We destroy or de- identify personal information we no longer need, wherever possible.
9. One Space and links to other web sites
One Space provides links to web sites outside of the One Space site. These linked sites are not under the control of One Space, and One Space is not responsible for the conduct of companies linked to the One Space web site, nor for the performance or otherwise of any content and/or software contained in such external websites.
10. Problems, queries or complaints
For further information regarding this Privacy Policy or to make a complaint about the steps taken by One Space to protect your personal information or privacy, please contact One Space’s Privacy Office by emailing info@onespacewellness.com We will investigate any complaints received in writing and do our best to resolve them as soon as possible.
